1. Acceptance of Terms
By accessing or using the Passion Care LLC website and services, you agree to be bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our site and services.
These Terms constitute a legally binding agreement between you and Passion Care LLC. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of our services constitutes acceptance of the revised Terms.
2. Description of Services
Passion Care LLC provides non-medical and medical home care services including, but not limited to: companion and housekeeping care, personal care aide services, home health aide services, memory and dementia care, rehabilitation support, palliative care, nutrition and meal preparation, and wellness services.
Services are provided pursuant to a written Service Agreement executed between Passion Care LLC and the client or authorized representative. The scope, schedule, and terms of care are defined in that individualized agreement.
3. Eligibility and Enrollment
To receive services from Passion Care LLC, clients must complete a new patient intake assessment. Services are available to individuals residing in our service area who meet our clinical eligibility criteria.
Passion Care LLC reserves the right to decline service to any individual if, in our professional judgment, we are unable to safely and adequately meet that individual's care needs. We will provide reasonable notice and assist in identifying alternative resources when possible.
4. Client Responsibilities
Clients and their authorized representatives agree to:
• Provide accurate, complete, and current information regarding the client's health status, medical history, and care needs.
• Notify Passion Care LLC promptly of any changes in health status, medications, or care needs.
• Treat all Passion Care LLC staff with dignity and respect. Harassment, abuse, or threatening behavior toward staff will result in immediate termination of services.
• Maintain a safe working environment for caregivers, including ensuring the home is free from known hazards.
• Provide reasonable access to the client's home at scheduled care times.
• Comply with the terms of the executed Service Agreement, including timely payment of fees.
5. Payment Terms and Billing
Payment for services is due in accordance with the terms specified in your individual Service Agreement. Passion Care LLC accepts various payment methods including private pay, long-term care insurance, and other approved funding sources.
Invoices are issued on a regular billing cycle as specified in your Service Agreement. Accounts more than 30 days past due may be subject to a late fee and/or suspension of services. Clients are responsible for any costs associated with collections.
All fees are subject to change with reasonable advance notice. Any disputes regarding billing must be submitted in writing within 30 days of the invoice date.
6. Cancellation and Scheduling Policy
We understand that schedules change. To cancel or reschedule a care visit, please provide at least 24 hours advance notice by calling 404-287-4426 or emailing

Cancellations with less than 24 hours notice may be subject to a cancellation fee as specified in your Service Agreement. Repeated last-minute cancellations may affect your care scheduling priority.
Passion Care LLC reserves the right to cancel or reschedule services in the event of caregiver illness, severe weather, or other circumstances beyond our control. We will make every reasonable effort to provide a qualified substitute caregiver.
7. Caregiver Assignment and Substitution
Passion Care LLC will make reasonable efforts to assign a consistent caregiver based on client needs and preferences. However, we cannot guarantee the availability of any specific caregiver at all times.
In the event a regular caregiver is unavailable, we will provide a qualified substitute. All substitute caregivers meet the same screening, training, and certification standards as regular caregivers.
Clients may request a caregiver change by contacting our office. We will make reasonable accommodations to address compatibility concerns.
8. Limitation of Liability
Passion Care LLC provides home care services with the highest standard of professional care. However, we are not liable for any outcomes resulting from pre-existing medical conditions, client non-compliance with care plans, or circumstances beyond our reasonable control.
To the maximum extent permitted by applicable law, Passion Care LLC's total liability for any claim arising from our services shall not exceed the total fees paid by the client in the three months preceding the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services or website.
9. Confidentiality
All client information is treated as strictly confidential. Passion Care LLC and its staff are bound by HIPAA regulations and our internal confidentiality policies. Client information will not be disclosed to unauthorized parties without written consent, except as required by law or as necessary to provide care.
All staff members sign confidentiality agreements as a condition of employment. Violations of client confidentiality are grounds for immediate termination and may result in legal action.
10. Grievance and Complaint Procedure
Passion Care LLC is committed to resolving client concerns promptly and fairly. If you have a complaint or grievance, please:

2. Submit a written complaint describing the issue, date, and parties involved.
3. A supervisor will acknowledge your complaint within two business days and initiate an investigation.
4. We will provide a written response within 10 business days.
If you are not satisfied with our resolution, you have the right to contact the appropriate state licensing agency or, for HIPAA-related concerns, the U.S. Department of Health and Human Services Office for Civil Rights.
11. Termination of Services
Either party may terminate the Service Agreement with reasonable written notice as specified in the individual agreement. Passion Care LLC may terminate services immediately in cases involving safety concerns, abusive behavior toward staff, non-payment, or misrepresentation of information.
Upon termination, Passion Care LLC will provide reasonable assistance in transitioning care to another provider when possible.

The content on this website, including text, graphics, logos, and images, is the property of Passion Care LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

13. Governing Law
